Terms of use

These terms are the agreement between you and us about your use of Tavilio. By creating an account you accept them. If you are accepting on behalf of a business, you are confirming you may bind it.

What Tavilio is

Tavilio is software a venue uses to take reservations, keep a floor plan, publish a menu and run a small website. We provide the software and keep it running. We are not party to anything that happens between a venue and its guests: the booking is the venue's, the table is the venue's, and so is the obligation to honour it.

Your account

You need an account to use Tavilio, and the details you give must be accurate. You are responsible for what happens under your account and for the people you invite to your venue. If you think someone else has your credentials, tell us. You must be old enough to enter a contract where you live, and the venue you run must be a real one you are entitled to represent.

Plans and payment

The plans, what each one holds and what it costs are on our pricing page, and the price shown there is the price charged. Hungarian venues are billed in forint, everyone else in euro.
  • The free plan is free, needs no card, and carries our badge on the venue's site.
  • Paid plans renew automatically — monthly on the same day each month, yearly on the same date each year — until they are cancelled.
  • Payment is taken by Stripe. We never hold your card details.
  • Prices exclude VAT where VAT applies, which is added at checkout on the basis of the address and tax number you give.
  • Cancel whenever you like, from Plan & billing in your settings. The plan runs to the end of the period you have already paid for and does not renew after that.
  • We do not refund part of a period unless the law where you are says otherwise, or unless we failed to provide the service and you ask.
  • If a payment fails, we will retry it and tell you. A subscription left unpaid returns the venue to the free plan, and the free plan's limits then apply — your data stays, but what exceeds the limit becomes read-only rather than being deleted.
If we change a price, we will give you at least 30 days' notice before it applies to you, and it takes effect at your next renewal. You may cancel before then.

Your content, and your guests

Everything you put into Tavilio — your menu, your photographs, your website copy, your floor plan, your bookings — stays yours. You give us only the permission we need to store it, process it and show it to the people you are showing it to, which is what running the service consists of. You are responsible for what you publish: that you have the right to the images, that your menu is accurate, that your allergen information is right, and that your own terms and privacy notice say what your guests need to know. For your guests' personal data you are the controller and we are your processor. We handle it on your instructions, only to provide the service. Our privacy policy sets out how, and it forms part of this agreement.

What you may not do

Do not use Tavilio to break the law, to send bulk or unsolicited email, to impersonate someone, to publish content you have no right to, or to take bookings for something other than the venue you registered. Do not attempt to reach parts of the system that are not yours, to work around a plan's limits, or to disrupt the service for anyone else. Do not resell Tavilio as your own product without a written agreement with us. We may suspend an account that is doing any of these, and will tell you why.

Availability

We work to keep Tavilio up, but we do not promise it will never be down. There is no uptime guarantee on any plan, and we may take the service down for maintenance. Where we can give notice of planned maintenance, we will. We may change how Tavilio works. If we remove something you rely on, we will give reasonable notice and, where we can, a way to get your data out.

Ending it

You can close your venue at any time from your settings. Deleting a venue deletes its data — its content, its uploaded files and its bookings — and that cannot be undone. Export anything you want to keep first. We may end this agreement if you break these terms and do not put it right after we ask, or if we stop offering Tavilio altogether. In the second case we will give reasonable notice and will not charge you for a period you cannot use.

Liability

Nothing here limits liability that cannot be limited in law — death or personal injury caused by negligence, or fraud. Otherwise: Tavilio is provided as it is, we do not promise it will be free of faults, and we are not liable for indirect or consequential loss, lost profit, lost bookings or lost goodwill. Our total liability in any twelve-month period is limited to what you paid us in that period. Your venue's obligations to its guests are yours, not ours. If a guest arrives and the table is not there, that is between you and the guest.

Changes to these terms

We may change these terms. If a change matters, we will tell you before it applies — by email or in the app — and move the date at the top of this page. Continuing to use Tavilio after that means you accept the new version. If you do not, close your account.

Law

These terms are governed by the law stated below, and the courts there have jurisdiction. If you are a consumer, this does not take away the protection of the mandatory law of the country you live in.
